The petitioner apprehends his arrest in Complaint case No. 999/2009 under Section 323, 406 of the Indian Penal Code.

Compounder of the petitioner made allegation that petitioner took Rs. one lac from him to get him admitted in Medical Institute for obtaining degree of B.D.S. The learned counsel for the petitioner submits that the entire allegation is false and concocted. No chit of paper is shown that petitioner received any money. The money was given in the year 2006 but the complaint was filed in the year 2009. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned

Patna High Court Cr.Misc. No.45921 of 2016 (2) dt.25-11-2016 2/2 court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Gopalganj in Complaint Case No. 999 of 2009, Tr. No. 7 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
