JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 26-04-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Hajipur Sadar P.S. Case No. 594 of 2021, Session Trial No. 200 of 2022, registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code. The petitioner is wife of the deceased. The allegation against him is that he committed murder of his wife. The learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in this case. The petitioner is under custody since 28.06.2021. On the other hand, the learned APP has opposed the prayer for bail and submitted that there is clear and explicit
Patna High Court CR. MISC. No.57379 of 2022(5) dt.26-04-2023 2/2 allegation in the FIR that the petitioner killed his wife pressing her throat. He has submitted further that the witnesses, in paragraph nos. 33 and 34 of the case diary, have stated that there was some altercation between husband and wife for the reason that the petitioner had sold golden Jetiya of the deceased and he consumed liquor, for the money received.
There is allegation against the petitioner that he strangulated his wife to death. The allegation is corroborated by post-mortem report, which shows that cause of death was asphyxia (throttling).
In my view, the petitioner does not deserve the privileges for bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Nirmal/- U T
