The petitioner seeks bail in Basantpur P.S. Case No. 86 of 2012 under Sections 498A, 304B and other sections of the Indian Penal Code.

The petitioner is the husband of the deceased. It is submitted that omnibus and general allegations have been made against the petitioner. All other accused persons have already been enlarged on bail. The police, after investigation, submitted chargesheet under Section 302 I.P.C., but there is no eye witness of the occurrence.

On the other hand, learned counsel for the informant vehemently opposed the prayer for bail.

Having considered the facts that the petitioner is the husband of the deceased and prior to this case, the wife had lodged

Patna High Court Cr.Misc. No.43464 of 2014 (3) dt.20-04-2015 2/2 a case against the petitioner for subjecting her to physical and mental torture and also causing burn injury and thereafter the case was compromised, but the deceased was killed and her dead body was concealed, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
