The petitioners apprehend their arrest in Katihar Town P.S. case No. 256 of 2017 under Section 304B/34 of the Indian Penal Code and under Section 3⁄4 of Dowry Prohibition Act. The mother of the deceased alleged that her daughter was married to Anil Agrawal in the year 2009 and her husband and other in-laws were subjecting her to different sorts of torture. The informant got information on 24.04.2017 that her daughter was killed.
The learned counsel for the petitioners submits that petitioners are father-in-law and mother-in-law of the deceased. The marriage was solemnized in the year 2009. The deceased died
Patna High Court Cr.Misc. No.34820 of 2017 (2) dt.10-08-2017 2/2 on account of intestinal haematoma and haematoma was found in her skull. There was no external injury. The petitioners have no manner of concern with the family affairs of the deceased and her husband.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. case No. 256 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
