The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is a person with one antecedent under the Excise Act and the informant alleges that his father was shot and he was admitted in SKMCH where he disclosed that the occurrence has been committed by Ghanshyam Patel and his wife Bebi Patel. The learned counsel for the petitioner submits that petitioner is not named in the FIR and his name transpired in the confessional statement of Ghanshyam Patel in police custody

Patna High Court CR. MISC. No.60461 of 2022(9) dt.22-06-2023 2/3 which does not have any evidentiary value. It is next submitted that petitioner will not abscond rather will cooperate in the investigation and will present himself as and when required by the Investigating Officer of the case.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ahiyapur P.S. Case No. 1197 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

However, in the event if any application filed on behalf of the Investigating Officer that petitioner despite giving assurance to this Court is not cooperating in the investigation or is not presenting himself when required. The learned trial court will be at liberty to cancel his bail bonds after recording the reasons.
