JUSTICE RAVI RANJAN ORAL ORDER 08-03-2016 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in a case registered for the offences punishable under sections 304(B), 201 and 34 of the Indian Penal Code.
Petitioner no. 1 is the father-in-law, petitioner no. 2 is the mother-in-law and petitioner no. 3 is the brother-in-law of the deceased.
It is contended that the allegation against the petitioners is general and omnibus in nature and it has come during the investigation that the deceased was mentally ill. It is further contended that the husband of the deceased has already surrendered in the court below and in support thereof, a certified
Patna High Court Cr.Misc. No.40670 of 2015 (5) dt.08-03-2016 copy of the order dated 03.03.2016 has been produced at the time of hearing. Let it be kept on the record.
Having regard to the facts and circumstances of the case, let the abovenamed petitioners, namely, Ranjeet Yadav, Sushila Devi and Ravi Kumar, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Rampur Chauram Police Station Case No. 23/2015 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the ACJM, Jehanabad, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure. Further, the petitioners shall remain present on each and every date during the course of the trial in the court below. If the petitioners fail to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
