The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366, 366A, 376, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.06.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that her daughter was kidnapped by the petitioner.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, it has been specifically pleaded in paragraph '7' of the bail application that

Patna High Court CR. MISC. No.69600 of 2021(2) dt.26-04-2022 2/2 the victim is residing in the house of the petitioner and they have married and have two children out of the wedlock. It is further submitted that the case has even been compromised between the parties.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 24.06.2021, is a person with clean antecedent, chargesheet has been submitted in the case and it has been specifically pleaded in the bail application that the victim is staying in the house of the petitioner and has married and out of the wedlock two children were born who are also staying with the victim, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Masaurhi P.S. Case No. 380 of 2019 arising out of Complaint Case No. 229(c) of 2019.
