The petitioner seeks bail in a case registered for the offence under Section 25(1-b)a, 26, 35 of the Arms Act. One mobile phone of Oppo company has been recovered from the possession of the petitioner. It is submitted on behalf of petitioner that no arms or ammunition has been recovered from the conscious possession of the petitioner and the alleged mobile phone actually belongs to petitioner himself, which he had purchased on 10.02.2020 (retail invoice is kept at Annexure 2 to the petition). Petitioner is in custody since 15.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Patna High Court CR. MISC. No.68719 of 2021(3) dt.21-03-2022 2/2 Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sheohar in connection with Piprahi P.S. Case No. 55 of 2021.
