JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Complaint Case No. 245 of 2016 for the offence punishable under section 406 of the I.P.C. As per the allegation made in the complaint petition the dispute appears of civil nature.

Inspite of Vakalatnama filed on behalf of the opposite party no.2, no one is appearing on his behalf to oppose the bail application. The learned counsel for the petitioner submits that after creating forged agreement the complainant has filed this false

Patna High Court Cr.Misc. No.16657 of 2017 (4) dt.11-07-2017 2/2 case and only with a view to harass the petitioner this complaint case has been filed.

In the facts and circumstances as stated above, considering the nature of dispute, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M-IV, Nawadah in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
