The petitioner apprehends his arrest in Kalyanpur P.S. Case No. 73/2015, registered for the offences punishable under Sections 419, 420 and 406 of the Indian Penal Code and 138 of the N.I. Act.

The informant alleged that he lent Rs. 1,50,000/- to the petitioner for treatment. The petitioner gave a cheque of Rs. 1,50,000/- of the ICICI Bank. When the cheque was presented, the same was dishonoured.

Learned counsel for the petitioner submits that the petitioner neither issued any cheque nor any cheque is brought on record to show about dishonouring of the cheque.

No.46796 of 2016 (2) dt.07-12-2016 2/2 Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Motihari, East Champaran in connection with Kalyanpur P.S. Case No. 73/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
