Petitioner, already in custody, seeks bail in connection with Khaira PS Case No.193 of 2016, registered under Sections 147, 148, 149, 341, 323, 324, 326, 307, 504 and 506 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code was added later on.
Allegation in brief is that when the son and nephew of the informant were playing at the construction site, quarrel took place and the accused persons assaulted the brother of the informant causing his death.
It is contended by learned counsel for the petitioner that the specific allegation of assault to the deceased by dangerous weapon, like, axe and sword is against Upendra
Patna High Court Cr.Misc. No.25936 of 2018(2) dt.02-05-2018 2/2 Yadav and Damodar Yadav, however, there is general and omnibus allegation against the petitioner as well as one another co-accused Kapil Yadav who was admitted to bail earlier by a co-ordinate Bench of this Court vide Cr. Misc. No.56255 of 2017 on 13.12.2017 and seeks bail of the petitioner on the ground of parity.
However, considering the aforesaid facts and circumstances, petitioner Rajesh Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Khaira PS Case No.193 of 2016.
