2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 25(1-B)a, 26 and 35 of the Arms Act, registered in connection with Dalsinghsarai P.S. Case No. 488 of 2023.

3. As per prosecution case, the informant apprehended one co-accused namely, Birbal Kumar, who disclosed in course of interrogation that he along with other co-accused including the petitioner had committed murder of one Jibbach Singh @ Prem Singh. Accordingly the FIR.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.65892 of 2024(2) dt.24-09-2024 2/3 that petitioner has been falsely implicated in this case and has committed no offence. Petitioner has no concern with the alleged occurrence. He submitted that petitioner is not the assailant of Jibbach Singh @ Prem Singh and petitioner was granted bail in connection with Dalsinghsarai P.S. Case No. 419 of 2023. On the basis of suspicion and due to his criminal antecedents, he has falsely been implicated in this case. No incriminating article has been recovered from the conscious possession of the petitioner and he is in custody since 18.12.2023.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case as well as period of custody, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Dalsinghsarai, Samastipur in connection with Dalsinghsarai P.S. Case No. 488 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court.
