JUSTICE RAJIV ROY ORAL ORDER 30-01-2023 Heard Mr. Umesh Chandra Verma, learned counsel for the petitioners and learned APP for the State. The petitioners apprehend their arrest in connection with Pakaridayal P.S. Case No.205 of 2021 instituted under Sections 304(B), 201, 120(B)/34 of the Indian Penal Code. As per the prosecution story, the informant alleged that his daughter was married to accused Rahul Kumar in the year 2021 but was always tortured for dowry. On the fateful day, he came to know that she has been burnt to death and the dead body cremated. Accordingly, the FIR was lodged. Learned counsel for the petitioners submit that these two petitioners are mother-in-law and father-in-law, living separately, do not have criminal antecedent and further

Patna High Court CR. MISC. No.57031 of 2022(2) dt.30-01-2023 2/2 submission is that the husband considering himself to be the protector of the lady, having failed to do so, intends to surrender within a period of one week.

Learned APP on the other hand opposes the prayer for anticipatory bail.

Taking into account that both the petitioners are mother-in-law and father-in-law, do not have criminal antecedent, as submitted by learned counsel for the petitioners the husband himself intends to surrender within a week, this Court is inclined to extend them privilege of bail. Let the petitioners be released on bail, in the event of their arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Pakaridayal P.S. Case No.205 of 2021 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
