JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-07-2017 This application is for grant of anticipatory bail in connection with Sherghati P.S. Case No. 27 of 2017 registered for the offence(s) under section(s) 414, 420, 467, 468, 471, 120(B) and 384 of the Indian Penal Code.

The petitioner is named in the FIR and on perusal of the FIR it appears that one truck was intercepted with loaded coal and when the documents were called for, the same could not be produced and the driver of the truck disclosed that he, on instruction of his owner, used to load stolen coal from Govindpur Swang and Mantu Singh (petitioner) prepared paper, on that basis, coal was supplied to other State. Submission of the learned counsel for the petitioner is that the co-accused, Parmeshwar Nayak, who is owner of the truck, has already been granted bail by a coordinate Bench of this Court, vide order dated 07.07.2017 passed in Cr. Misc. No. 27357 of 2017, after

Patna High Court Cr.Misc. No.33693 of 2017 (2) dt.20-07-2017 2/2 verification of document. The prosecution story is that the truck driver has valid document and thereafter, the truck has been released and on that basis, he has been granted anticipatory bail by this Court. Heard learned Additional Public Prosecutor also. Having heard both sides and in view of the facts and circumstances, as stated above, this application is allowed. Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati at Gaya in connection with Sherghati P.S. Case No.

27 of 2017, subject to the condition as laid down under Section 438 (2) Cr. P.C. Further condition is that the petitioner shall cooperate in the investigation of the case and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive occasions, his bail bond shall be liable to be cancelled.
