The petitioners, namely, Suresh Singh and Balchan Kumar Singh @ Balchand Kumar, apprehend their arrest in a case under Section 406 of the Indian Penal Code.
The complainant alleged that the petitioners and others took money from him for providing a job to his wife but neither the money was returned nor any job was provided. It is submitted that Sushila Devi, the mother of the present
Patna High Court Cr.Misc. No.43794 of 2015 (3) dt.16-12-2015 2/3 complainant, has filed Nawkothi P.S. Case No. 78/09, and she made allegation that the petitioners took money from her for providing job but neither any job was provided nor money was returned. Almost on same and similar allegation, the present complaint petition is filed by the son of Sushila Devi. Sri Akhileshwar Prasad Singh, learned senior counsel for the complainant, has, however, vehemently opposed the prayer for anticipatory bail and submitted that not only the complainant but all the three witnesses examined on his behalf very categorically and in definite terms stated that the petitioners took money from the complainant and the petitioners are in the habit of taking money from different persons for providing job.
Having considered the fact that the mother of the present complainant filed a case against the petitioners for taking money for providing a job and almost on same and similar facts the son of Sushila Devi, the informant of Nawkothi P.S. Case No. 78/09, filed the present case against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.43794 of 2015 (3) dt.16-12-2015 3/3 satisfaction of Shri Deo Priya, Judicial Magistrate, 1st Class, Begusarai in Complaint Case No. 1967C/2009, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
