JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 04.06.2019 in connection with Bodh-Gaya P. S. Case No. 248 of 2019, registered for the offences punishable under Sections 341, 323, 325, 307, 354 and 34 of the Indian Penal Code. Petitioner No. 1 is said to have assaulted the informant as well as his wife and so far as petitioner no. 2 is concerned, it is said that although he made attempt to assault the informant but informant got saved himself. The perusal of case diary goes to show that the concerned I.O. did not take any pain to collect the injury report of injured. Though, at para 18 of the

Patna High Court CR. MISC. No.55020 of 2019(5) dt.20-11-2019 2/2 case diary, the I.O. has only mentioned that a report regarding the injury of injured Champa Devi was received and the aforesaid report discloses that the injury found on the person of the injured Champa Devi was grievous in nature but the concerned I.O. did not mention as to on which part of the body of injured, the aforesaid grievous injury was found. However, the first information report reflects that the informant claimed that the injured Champa Devi had sustained grievous injury on her hand.

Considering the facts and circumstances of the case as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh-Gaya P. S. Case No. 248 of 2019.
