In absence of the provisions and the Rules in place, where any provision for reservation for disabled people has been provided in matters of promotion, the reason for rejection of the claim of the petitioner for grant of that benefit cannot be said to be erroneous.

So far as submission of the counsel for the petitioner is concerned, keeping in mind certain judicial pronouncements including the decision, which was rendered in the case of Rajeev Kumar Gupta & Ors. Vs. Union of India & Ors. by the Hon'ble

Patna High Court CWJC No.17262 of 2016 dt.14-12-2016 2/2 Apex Court on 30th June, 2016, and the statutory provisions dealing with the benefit of such reservation, liberty is granted to the petitioner to move the Registrar General with a request to bring the Rules of the High Court in conformity with the law of the land.
