JUSTICE RAKESH KUMAR ORAL ORDER 05-10-2015 At the very outset, learned AC to GP-29 submits that despite his best efforts, he has not been able to get instruction and, as such, no counter affidavit has been filed. Heard Syed Rizwanul Haque, learned counsel for the petitioner.

The petitioner, invoking writ jurisdiction of this Court under Article 226 of the Constitution of India, has prayed for quashing of Annexure-7 to the writ petition i.e. a communication contained in letter No.D.V.476 dated 02.06.2014, whereby the petitioner was asked to appear along with relevant paper regarding deposit of rent.

Learned counsel for the petitioner submits that in

Patna High Court CWJC No.13584 of 2015 (3) dt.05-10-2015 2/2 respect of fixation of rent, the petitioner has preferred an appeal vide House Control Appeal no.14/14 before the Collector, Sheikhpura. He submits that despite the fact that appeal was filed in the month of July 2014, till date no order has been passed and, as such, he makes a prayer for disposal of the present writ petition with an observation that the appellate authority may decide the appeal in accordance law.

Accordingly, even in absence of counter affidavit, the writ petition stands disposed of with an expectation that the learned Collector, Sheikhpura may take appropriate steps, so that House Control Appeal No.14/14 may come to its logical end without unnecessary delay.

The writ petition stands disposed of.
