JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-09-2015 Heard learned counsel for the petitioner, learned counsel for the informant and also learned A.P.P. for the State. The petitioner is accused in connection with S. Tr. No. 211 of 2015 arising out of Naubatpur P.S. Case No. 170 of 2012 registered under Sections 304B and 201/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that petitioner happens to be the husband of the deceased, whose marriage was performed on 11.07.2005 and the occurrence is said to be on 12.07.2012 after seven years of the marriage, in fact, one male child, namely, Hansh Raj, aged about 8 years, was born out of the wedlock. It is further submitted that deceased died due to

Patna High Court Cr.Misc. No.40448 of 2015 (3) dt.16-09-2015 illness and her last ceremony was performed but due to ulterior motive brother of deceased has lodged this false case. The prayer for bail of the petitioner was earlier rejected on 25.03.2014 passed in Cr. Misc. No. 33307 of 2013 and he is in custody since 04.02.2014.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-2, Danapur, Patna, in connection with S. Tr. No. 211 of 2015 arising out of Naubatpur P.S. Case No. 170 of 2012.
