JUSTICE MIHIR KUMAR JHA ORAL ORDER 30-09-2015 Learned counsel for the petitioners seeks permission to withdraw this application in order to enable the petitioners to surrender and make a prayer for regular bail in view of the law laid down by this Court in the case of Mahendra Singh Vs. State of Bihar reported in 2004(3) PLJR 491.

This application is, accordingly permitted to be withdrawn with the aforementioned liberty.

It, however, goes without saying that though the petitioners' anticipatory bail application will not be maintainable but, then, the court below will consider the prayer for bail of the petitioners strictly in accordance of law including the observation made in the case of Mahendra Singh (supra).
