The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 461 and 379/411 of the Indian Penal Code.
It is alleged that the petitioner along with co-accused Jitendra Kumar Yadav committed theft in the factor of the informant and taken away bicycle and 40 packets of biscuits.
It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case since the mother of the petitioner has filed complaint case against the informant and local police. A
Patna High Court Cr.Misc. No.46173 of 2016 (2) dt.22-10-2016 2/2 statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kotwali P.S. Case No. 373 of 2016 pending in the court of learned Chief Judicial Magistrate, Bhagalpur.
