The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.09.2019, charge-sheet has been submitted in the case and has antecedent of six cases. Learned counsel for the petitioner submits that three unknown criminals looted his motorcycle on point of gun. Learned counsel for the petitioner submits that the F.I.R. was against unknown, the petitioner was not put on T.I.P. nor any incriminating article was recovered from his possession and based on his antecedents, he came to be implicated in the

Patna High Court CR. MISC. No.68910 of 2021(2) dt.21-04-2022 2/2 present case as he was arrested in Khodawandpur P.S. Case No. 190 of 2019 in which he was made to confess about his participation in the occurrence.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 24.09.2019, charge-sheet has been submitted in the case, he was not put on T.I.P., no incriminating article was recovered from his possession and his name came in his own confessional statement, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Birpur P.S. Case No. 111 of 2019 with a condition that one of the bailors of the petitioner shall be his father, Bino Yadav.
