The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 324, 326, 307, 354B, 379, 380, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 28.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that while his son had gone for running, he was intercepted by the petitioner and named accused persons who assaulted him, but his son managed to flee and came back home. No.68915 of 2021(2) dt.21-04-2022 2/3 named accused persons came to the informant's house and Rajeev Kumar Das assaulted on head and eye of the informant by butt of a gun and Rajnish Kumar assaulted informant's son by farsa on head and other accused persons, including the petitioner, started misbehaving with his wife and daughter and also snatched golden chain and stole Rs. 45,000/-. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case and from bare perusal of the allegation as alleged in the F.I.R. it would manifest that Rajeev Kumar Das and Rajnish Kumar are alleged to have assaulted the informant and his son respectively and as far as this petitioner is concerned, it is alleged that he misbehaved with the wife and daughter of the informant.

Learned counsel submits that it is an exaggerated version of the occurrence only to give a serious colour to the case inasmuch as that ladies of the house were misbehaved by the petitioner but the F.I.R. is silent in that respect as to how the petitioner misbehaved with the victims.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 28.07.2021, is a person with clean antecedent and charge-

Case No. 226 of 2020.
