JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In huge quantity, Indian made foreign liquor as well as country made liquor were recovered from a tempo in which petitioner and four others including driver of the aforesaid tempo were found sitting.
Submission on behalf of the petitioner is that having similar allegation, one co-accused namely, Sikandar Manjhi, has already been granted privilege of bail by a co-ordinate Bench of this Court. Moreover, the alleged recovery has not been made from conscious possession of the petitioner, who was a bona fide passenger.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,
Patna High Court Cr.Misc. No.46159 of 2016 (2) dt.21-10-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai, Lakhisarai in connection with Lakhisarai P.S.Case No. 394 of 2016.
