JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 273 of the Indian Penal Code and Section 47(a) of Bihar Excise (Amendment) Act, 2016. In huge quantity, bottles of Indian made foreign liquor were recovered from the vehicle of the petitioner. Petitioner was caught on the spot and was remanded in this case on 15.07.2016 and since then he is in jail custody and prior to alleged occurrence, he had been made accused in Kishanganj P.S. Case No. 245 of 2015 for the offences of N.D.P.S. Act but in the aforesaid case, petitioner was granted privilege of anticipatory bail vide order dated 23.11.2015 passed in Cr. Misc. No. 53037 of 2015.

No.46196 of 2016 (3) dt.05-12-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Baisi P.S. Case No. 106 of 2016.
