The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376/511, 354, 323 and 341 of the Indian Penal Code. The prosecution case is that on 08.03.2015 at 11.00 P.M. the petitioner entered into the room of the informant and tried to ravish her.

It is submitted by learned counsel for the petitioner that the petitioner was being assaulted by the informant' husband on 08.04.2015 for which the petitioner filed Gopalganj Town P.S. Case No. 120 of 2015 making accusation under Sections 342, 325, 324/34 of the IPC and 3(1)(x) of SC/ST

Patna High Court Cr.Misc. No.41803 of 2015 (2) dt.09-10-2015 2/2 (Prevention of Atrocities) Act. The petitioner in the said incident received grievous injury, thereafter for the occurrence of 08.03.2015 the complaint was filed 15.04.2015 which came to be registered as police case on 02.05.2015.

Considering the delayed lodging of the case, the case lodged by the petitioner at earlier point of time and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj (Town) P.S. Case No. 151 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
