The petitioner seeks bail in Chandi P.S. Case No. 536 of 2020 corresponding to Sessions Trial No. 442 of 2021, registered for the offence punishable under Sections 366(A), 120(B) of the Indian Penal Code.

As per the prosecution case, minor daughter of the informant had gone to market to purchase some articles, but she did not return. Subsequently, informant came to know that this petitioner along with other FIR named accused persons kidnapped his daughter.

It is submitted on behalf of the petitioner that the alleged occurrence took place on 11.11.2020, but the FIR was lodged on 22.11.2020 after delay of eleven days and there is no plausible explanation for such delay. Informant is not eye-

No.68722 of 2021(2) dt.03-03-2022 2/2 witness of the occurrence and has not disclosed the source of information as to how he came to know that petitioner along with other accused persons involved in the alleged occurrence. Similarly situated co-accused has been granted bail by this Court vide order dated 07.01.2022 passed in Cr. Misc. No. 46737 of 2021. Petitioner claims clean antecedent and he is in custody since 24.03.2021. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd, Hilsa, Nalanda in connection with Chandi P.S. Case No. 536 of 2020 corresponding to Sessions Trial No. 442 of 2021.
