JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier the prayer for bail of the petitioner was twice rejected by a co-ordinate Bench of this court but submission on behalf of the petitioner is that co-accused, Mantu Singh and Hare Ram Hazari @ Dablu Hazari have already been granted privilege of bail by this court whereas petitioner is in jail custody since 05.08.2014 and up till now, only charge could be framed against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact

Patna High Court Cr.Misc. No.47195 of 2016 (2) dt.28-10-2016 2/2 that the allegation levelled against the petitioner is identical to coaccused, Mantu Singh, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Khagaria in connection with Sessions Trial No. 14 of 2015 arising out of Parwatta P.S.
