JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-05-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 498(A) and some other ancillary Sections of the Indian Penal Code. It is submitted that specific allegation of commission of torture is against co-accused, Dharmendra Paswan, husband of the informant. Petitioner is alleged to have illicit relation with Dharmendra Paswan and she assaulted the mother of informant with Fasuli on her head. It is submitted that petitioner is not the family member of the husband of informant and she has no concern with the family affairs of informant or her husband. The injury has been found to be simple in nature. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.68603 of 2021(2) dt.26-05-2022 2/2 prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Barachatti PS case No. 693/2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
