No. 30491 of 2018 seeks modification of the order dated 16.05.2018 granting bail to the petitioner stating therein that because of typographical error in the village name of the petitioner in the bail petition filed by the petitioner, it was incorporated as Rajapura in place of Gajupura
Patna High Court Cr.Misc. No.35548 of 2018(4) dt.18-07-2018 2/3 and because of the difference in the village name, the bail order could not be implemented.
Side by side, Cr. Misc. No. 35548 of 2018 has been filed by the Union of India seeking cancellation of bail bringing to the notice of this Court that before the bail order could be passed, an order was passed in Cr. Misc. No. 31039 of 2017 in the case of the petitioner, whereby on the report received from the court of Ist Additional Sessions Judge, Muzaffarpur time to conclude the trial in connection was DRI Case No. 51/2016, Trial No. 06/2018 was further extended for three months vide order dated 25.04.2018, but unfortunately this order was not brought to the notice of this Court while granting bail to the petitioner vide order dated 16.05.2018 in Cr. Misc. No. 30491 of 2018.
Time of three months is to expire on 24.07.2018. In the meantime, interim order dated 20.06.2018 was passed in the present case that the order dated 16.05.2018 granting bail to the petitioner in Cr. Misc. No. 30491 of 2018 would not be implemented.
Learned counsel for the Union of India submits that the trial is at a conclusion stage and seeks two weeks time. Put up on 01.08.2018. In the meantime, interim order
Patna High Court Cr.Misc. No.35548 of 2018(4) dt.18-07-2018 3/3 dated 20.06.2018, passed in Cr. Misc. No. 35548 of 2018 shall continue.
