The petitioner is in custody since 24.06.2019 in connection with Sonpur P.S. Case No.439 of 2019 registered for the offence under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that only because the petitioner was not having valid papers, it is presumed that the motorcycle in question was a stolen motorcycle and he has been taken into custody. It is further submitted that it is a case of false implication and that the petitioner is not having any criminal antecedents.
