The petitioner seeks bail in Thawe P.S. Case no. 71/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The petitioner Baliram Singh is of course named in the FIR but Raju Kumar Singh, the informant alleged that Shailesh Singh and Om Prakash Singh assaulted him and his brother Amit Singh, the deceased. The petitioner was touching sword, but there is no allegation against the petitioner that he assaulted anyone. Amit Kumar Singh died during course of treatment. There is a counter version.

Taking into consideration the facts aforesaid and the fact that there is no allegation of assault against the petitioner, the

Patna High Court Cr.Misc. No.41499 of 2015 (2) dt.10-09-2015 2/2 petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Thawe P.S. Case no. 71/2015.
