JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 19-11-2016 Heard the counsel for the petitioner and the State. The petitioner prays for bail in Ara Nagar P.S. Case No. 73 of 2016 registered under section 420 IPC.

The FIR was lodged against unknown alleging that while the informant was at the ATM kiosk/booth one person came and started helping and in the process he changed the ATM card of the petitioner who subsequently found that a sum of Rs. 80060/- was withdrawn from his account using his ATM card. It is stated that during investigation 02 accused persons including the petitioner was suspected as accused(s) and put on TIP wherein the co-accused Mohit Kumar was identified by the informant. The petitioner is in custody since 23.08.2016.

Considering the facts and circumstance of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Bhojpur at Ara in Ara Nagar P.S. Case No. 73 of 2016 on condition

Patna High Court Cr.Misc. No.46305 of 2016 (3) dt.19-11-2016 2/2 that one of the bailors shall be his own/close family member. In the event of framing of charge, the petitioner shall appear personally on each date fixed at the trial. In case he skips his appearance thereat on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
