Petitioner apprehends his arrest in connection with Tarari P.S. Case No.71/2022, registered for the offence punishable u/s 341, 323, 307, 504, 506 and 34 of the IPC.

As per the prosecution case, the petitioner and other accused persons assaulted the informant by means of lathi, danda and iron rod and threatened to kill him. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged, has ever taken place. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. There is an

Patna High Court CR. MISC. No.60127 of 2023(2) dt.13-10-2023 2/2 admitted land dispute between the parties and for the alleged occurrence there is case and counter-case between the parties. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail by submitting that from bare perusal of the impugned order, it is clear that the informant has sustained grievous injury and there is specific allegation against the petitioner that he assaulted the informant by means of iron rod.

Having regard to the facts and circumstances of the case and considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

This application is accordingly dismissed.
