2. The petitioner seeks bail in connection with Fatuha P.S. Case No. 614 of 2024 instituted for the offences under Sections 80(2)/3(5) of the B.N.S., 2023.

3. As per prosecution case, the accusation against the accused persons including the petitioner is of being involved in committing of murder of the Informant's sister due to nonfulfillment of dowry demand.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case merely on the basis of suspicion. The petitioner is the husband

He further submits that as a matter of fact, the deceased used Heater and, by mistake, she came in contact with the wire and died due to electrocution. The petitioner has never demanded any dowry from the deceased. The charge-sheet has been submitted in this case. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent and is languishing in judicial custody since 07.09.2024 without any rhymes or reason. Learned counsel for the petitioner again submits that the co-accused namely Diplesh Kumar @ Vakil Kumar has been granted bail by this Court vide order dated 04.03.2025 passed in Cr. Misc. No. 12662 of 2025 .

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature. The petitioner is the husband. The informant in the re-statement and several witnesses have supported the prosecution case. The inquest report suggests the case of death of the deceased due to electrocution. In the postmortem report, the cause of death has been shown as electrocution. The Investigating Officer, after completion of investigation, has submitted charge-sheet against the petitioner for offence under Sections 80(2)/3(5) of the B.N.S., 2023.

Having heard learned counsel for the parties and in the facts and circumstances of the case and keeping in view the nature of allegation, gravity of the offence, materials available in the case diary and as also the postmortem report of the deceased, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for bail of the petitioner, above named, is rejected with a direction to the court below to expedite the trial and conclude the same expeditiously (Rudra Prakash Mishra, J) rishi/- U T
