JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-04-2022 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Parmanand Kumar, learned A.P.P. for the State. This is the second attempt of the petitioner to obtain bail in connection with Town P.S. Case No. 18 of 2020 registered for the offences punishable under Section 392 of the Indian Penal Code. He is in custody since 26.02.2020. The petitioner has got seven criminal antecedent as stated in paragraph '3' of the application.
Earlier the prayer for bail was rejected with liberty to the petitioner to renew his prayer for bail after six months. A report has been received from the Principal
Patna High Court CR. REV. No.745 of 2021(3) dt.06-04-2022 2/3 Magistrate, J.J.B., Begusarai vide letter no. 487 dated 11.03.2022 from which it appears that the case is still pending for evidence.
Learned counsel for the petitioner submits that the order rejecting the prayer for bail of the petitioner was passed on 12.04.2021. Petitioner has stayed in the remand home for more than two years. It is his submission that till date the case is pending at the stage of evidence.
Learned A.P.P. for the State has though opposed the prayer for bail of the petitioner, but considering that the petitioner has remained in the Juvenile Home for more than two years and at this stage the case is still pending for evidence as also that his father, who has clean antecedent, is ready to stand a surety, this Court directs release of the petitioner above named on bail on furnishing of bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Principal Judge, J.J. Board, Begusarai in connection with J.J.B. Case No. 110 of 2020, arising out of Town P.S. Case No. 18 of 2020, subject to the condition as laid down under Section 437 (3) Cr.P.C. One of the bailors shall be the father of the petitioner who will furnish an undertaking that while on bail he would not

During the period the petitioner remains on bail, the Probation Officer attached to the Juvenile Justice Board, Begusarai shall keep vigil over the conduct of the petitioner and in case any adverse report is made to the Juvenile Justice Board, appropriate action shall be taken thereof.
