JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2019 Petitioner has filed the present writ application, challenging the order of suspension dated 18.3.2016. In view of Bihar Government Servants (Classification, Control & Appeal) Rules, 2005 suspension cannot continue for indefinite period.
The order of suspension was challenged on the ground that it is more than two years old.
Considering the aforesaid, the writ petition is allowed. The order of suspension is quashed.
Patna High Court CWJC No.9436 of 2018(2) dt.01-07-2019 2/2 The respondents are directed to reinstate the petitioner with all consequential benefits including payment of current salary and allowances to the petitioner within a maximum period of 30 days from today and conclude the departmental proceeding, if not concluded within a period of 3 months, failing which departmental proceeding shall automatically come to an end on expiry of three months.
With the aforesaid, the writ petition stands disposed of.
