This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 392 of the Indian Penal Code, registered in connection with Sherghati (Dobhi) P.S.Case No. 117 of 2021.

As per allegation, the informant and his associates in connection with a business, came to Bihar form Uttar Pradesh. When they were preparing meal, some accused persons entered into their abode and started assaulting them. At the point of firearm, they snatched articles and cash from the possession of the informant and his associates.

The learned counsel for the petitioner has submitted that he is not named in the FIR. Nothing was recovered from his possession and he is in custody since 19.02.2022. On similar footing, co-accused Niraj Kumar @ Niraj Singh and Tunnu Paswan have been granted bail in Cr.Misc.Nos.45085 of 2021

Patna High Court CR. MISC. No.62519 of 2022(4) dt.28-03-2023 2/2 and 55887 of 202, respectively, by the coordinate Benches of this Court and the case of the petitioner is on similar footing. Considering the above facts and circumstances and keeping in view the period of incarceration, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sherghati, Gaya in connection with Sherghati (Dobhi) P.S.Case No. 117 of 2021, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
