2. The petitioner seeks regular bail in connection with Ariyari (Kasar O.P.) P.S. Case No. 205 of 2018 dated 24.11.2018, lodged under Sections 147, 148, 149, 323, 341, 324, 307, 448, 354 of the Indian Penal Code and later on section 302 of the IPC has been added.
3. As per the prosecution case, FIR has been lodged against five named accused persons including the present petitioner. The specific allegation against the present petitioner is that he has assaulted the informant due to which injury has been caused.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.62665 of 2024(2) dt.04-09-2024 2/3 petitioner is innocent and has committed no offence. Counsel submits that during investigation, police has found no case against the two named accused persons including the petitioner, but subsequently, the Trial Court has taken cognizance against all the accused persons and thereafter, cognizance has been taken. Counsel further submits that other co-accused person namely Sudhir Mahto @ Sudhir Kumar has been granted bail by this Court vide order dated 28.06.2023 passed in Cr. Misc. No.32673 of 2023.
5. Learned counsel for the petitioner further submits that the criminal antecedent of the petitioner is clean and he is in custody since 03.04.2024. Counsel submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.
6. Learned APP for the State opposes the prayer for bail of the petitioner and submits that final form has come, but subsequently, Trial Court has taken cognizance against the petitioner also.
7. In the present facts and circumstances of this case, let the petitioner above named be granted bail, and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned
Patna High Court CR. MISC. No.62665 of 2024(2) dt.04-09-2024 3/3 District & Sessions Judge, Sheikhpura in connection with Ariyari (Kasar O.P.) P.S. Case No. 205 of 2018, subject to the conditions as laid down U/s 437(3) Cr.P.C.
