The petitioner is apprehending his arrest in connection with Maner P.S.Case No. 113 of 2017 registered for the offences punishable under Sections 328, 376 and 511 of the Indian Penal Code, including 8, 12 of POSCO Act.

Allegation against the petitioner and one co-accused is that they have forcibly abducted the daughter of the informant and made her unconscious and thereafter she was taken away. It has been submitted on behalf of the petitioner that the statement of the victim girl recorded under Section 164 Cr.P.C. shows that nothing has happened to her and her statement is contradictory to the allegation made in FIR.

Heard learned APP and learned counsel for the

Patna High Court Cr.Misc. No.33606 of 2017 (2) dt.20-07-2017 2/2 informant also.

Having heard both sides and in view of the statement under Section 164 Cr.P.C. of the victim girl, I am not inclined to grant anticipatory bail to the petitioner.

Let petitioner surrender in the court below and pray for regular bail, which shall be considered on its own merit. This application is dismissed.
