====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-11-2019 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners were granted provisional anticipatory bail in a case for the offence registered under Sections 304(B) and 201/34 of the IPC.
The prosecution story, in brief, is that the informant married his elder daughter, namely, Ramita Devi @ Bhuari on 30.06.2017 with co-accused Subash Sah and she came to her Sasural where all the F.I.R. named accused persons including the petitioners used to demand L.C.D. T.V., gold chain and cash
Patna High Court CR. MISC. No.55948 of 2019(3) dt.16-11-2019 2/2 of Rs. 2,00,000/- in further dowry and due to non-fulfilment of the same, on 06.09.2018 they murdered his daughter and threw her dead body in a plastic bag in the sugarcane field of Sankar Ram with a view to disappear the evidence of murder. It has been submitted by learned counsel for the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioner no. 1 is the Dewar, petitioner no. 2 is the father-in-law and petitioner nos. 3 and 4 are cousin fathers-in-law of the deceased. They are separate in mess and property from the husband of the deceased. On behalf of the learned counsel for the State, it has been submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, the provisional anticipatory bail granted to the petitioners vide order dated 03.09.2019, is hereby confirmed.
