The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
As per allegation, it is a case of murder of informant's younger brother (deceased) who was living with one Rita Devi as his wife for the last one year in his house after leaving her husband.
It has been submitted of behalf of the petitioner that the petitioner has got no criminal antecedent. He is in custody since 23.02.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence against the
Patna High Court Cr.Misc. No.40941 of 2015 (3) dt.29-10-2015 P2/2 petitioner. As per the prosecution case, the informant claims to have seen the petitioner fleeing away from the place of occurrence at 02:00 in the night but there is no source of identification disclosed by the informant. Except the aforesaid evidence, there is no other direct or indirect evidence to suggest the implication of the petitioner in the present case.
It has been submitted on behalf of the State that petitioner is named in the First Information Report. Considering the aforesaid facts and circumstances, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Chautarwa (Bathwaria) P.S.
