The petitioner apprehends arrest in connection with Shikarpur P.S. Case No. 493 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of seizure list, it is evident that the alleged recovery has been made near the bank of river. Petitioner has no concern with the recovered illicit materials. Further he submits that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

No.68860 of 2021(2) dt.29-04-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 493 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
