The petitioner, who is in custody, seeks bail in connection with Bahera P.S.Case No. 277 of 2016 registered under Sections 8, 20(b)(ii)(A), 20(b)(ii)(B) and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Allegation against the petitioner is that 01 Kg of Ganja was recovered from his house.

It is submitted by learned counsel for the petitioner that the recovery was not made from his conscious possession rather the house is occupied by several family members and this petitioner has got no criminal antecedent and has been in custody since 17.09.2016.

Having considered the aforesaid facts and

No.46418 of 2016 (3) dt.07-02-2017 2/2 circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge/Sessions Judge, Darbhanga, Bihar in connection with Bahera P.S. Case No. 227 of 2016 with condition that one of the bailors shall be a close relative of the petitioner. The petitioner shall be physically present before the court below during trial on each and every date and if he fails to appear on two consecutive dates, his bail bonds shall be liable to be cancelled.
