The S.I. lodged the case alleging that on account of killing of one person in the village, the villagers blocked the road, when the police party went there rioters became violent and did not accede to the request and committed minor offence. Contention of the petitioners is that allegation is general and omnibus.

Learned APP for the State, on the other hand, submits that that there is specific allegation attributed to the petitioners that they played an active role.

Looking to the allegations and the materials on the

Patna High Court Cr.Misc. No.47969 of 2016 (2) dt.09-12-2016 2/2 records, I am not persuaded to extend them the privilege of anticipatory bail. Prayer is, accordingly, rejected. Let the petitioners surrender and pray for regular bail before the Court below. If they do so, the same shall be considered on its own merit unprejudiced by the present order.
