JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 21-08-2018 The petitioner seems to be aggrieved by the delay being caused in investigation of Bahera P. S. Case No. 391 of 2013 lodged under Sections 467, 468, 471 and 420 of the Indian Penal Code.

Learned counsel for the State is present.

In the nature of the relief prayed for on behalf of the petitioner, let the petitioner file an appropriate application to the court of Judicial Magistrate in whose jurisdiction this case is

Patna High Court Cr. WJC No.1119 of 2016(2) dt.21-08-2018 2/2 pending. On filing such application the learned Judicial Magistrate shall pass an appropriate order directing the Investigating Officer to complete the investigation keeping in mind the judgment of the Hon'ble Supreme Court in the case of Sakiri Vasu Vs. State of U. P. & Ors. reported in 2008 (2) SCC 409. The court below shall competent to monitor and supervise the investigation in terms of the judgment of the Hon'ble Supreme Court. In case it is found that the Investigating Officer is not taking interest in the investigation of the case, he may direct the supervisory authority of the Investigating officer to change the Investigating Officer of the case.

This writ application is disposed of with the aforesaid observation.
