The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 353 and 427 of the Indian Penal Code. The prosecution case is that the informant being the police officer went to execute warrant and apprehend one Mukesh Choudhary when Mukesh Choudhary caused injury to the informant with sharp edged 'fasuli' and, thereafter, petitioner and others assaulted the other police officials.
It is submitted by learned counsel for the petitioner that the accusation is omnibus and general and there is nothing on record to suggest that apart from the informant other police officials also received injuries. It is further submitted that
Patna High Court Cr.Misc. No.41678 of 2015 (2) dt.08-10-2015 2/2 petitioner has been roped in the present case since he is neighbor of Mukesh Choudhary. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Pakribarawan P.S. Case No.58 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
