JUSTICE MADHURESH PRASAD ORAL ORDER 18-04-2018 It is submitted by learned counsel for the appellant that in view of amended pecuniary jurisdiction since the appeal is required to be file before the District Judge, he may be permitted to withdraw this appeal with liberty to file the same afresh before the appropriate District Judge. He submits that time spent in the instant proceedings may be condoned for the purpose of limitation.

If the appellant presents the appeal before the appropriate District Judge as prayed for, it will be open to the court below to dispose off the petitioner's appeal considering the fact that time has lapsed during pendency of the appeal before this Court.

The appeal stands disposed off.
