JUSTICE MADHURESH PRASAD ORAL ORDER 01-10-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 413, 414,420, 400, 401,201,216A of the IPC and sections 25(1b)A, 26 of the Arms Act. Petitioner's counsel submits that merely because his name has been disclosed by apprehended accused Binit Kumar @ Golu Singh, he has been roped in this case on the basis of suspicion. He has no connection with the recovered articles and from the FIR itself it is apparent that when raid was conducted at petitioner's house, police was informed that the petitioner was already in jail. In the circumstance, allegation of the petitioner's involvement is false.

Patna High Court CR. MISC. No.54984 of 2019(3) dt.01-10-2019 2/2 Learned A.P.P. submits that the petitioner has criminal antecedent.

Petitioner verified that in most of the six cases disclosed in para 3 of the petition, he is already on bail. He is in custody in this case since 04.05.2019.

Considering the aforesaid submissions, this court is inclined to grant him on bail. The same is allowed. Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Durgawati P.S. Case no. 66/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
