The petitioner seeks anticipatory bail in Sarai P.S. Case No.160 of 2016 instituted for the offences under Sections 25(1b)A, and 26 of the Arms Act. The police on information has raided the house of the petitioner and from the courtyard a double barrel gun has been recovered.
Learned counsel for the petitioner has tried to show that petitioner has no connection with the aforesaid gun but surrounding facts discloses against him.
In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders
Patna High Court Cr.Misc. No.19150 of 2017 (5) dt.12-07-2017 before the court below within a period of three weeks, the court below will pass an order on the same day on its own merit without being prejudiced by the order passed by this Court.
